Terms and Conditions of Sale
Terms of Use
Please note, any purchase made through this website constitutes an agreement to abide by the terms and conditions detailed below which shall override any other terms and conditions. Any contracts or agreements formed between you and us by means of this website shall be governed and construed according to English law and any disputes or proceedings shall be subject to the exclusive jurisdiction of the English courts.
Online Shopping
We have taken care in presenting the products on our website as accurately as possible. The images you see will depend on your monitor's display and colour capabilities. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise. Before you place an order you should read these terms and conditions together with the following: Orders, Delivery Information and Returns Policy. These pages form part of these terms and conditions and contain important information about your order.
Validation Checks
All credit, debit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
In addition, in the interests of preventing fraudulent use of credit, debit and charge cards, we may validate the names, addresses and other information supplied during the order process against commercially available records (e.g Electoral Roll data, Credit Reference Services). A third party may also be instructed to complete these checks. By ordering from the SHO Fine Jewellery website you consent to such checks being made. We may need to contact you by letter, telephone or email to verify details before we are able to process and dispatch your order, or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information.
All information provided will be treated in accordance with our Privacy Policy and the Data Protection Act 1998. These measures are taken as extra protection for you, to ensure your online shopping experience with us is as safe and secure as possible.
Orders
Once you have completed an online purchase, we will send you an email confirming the order details and our acceptance of your order. At that point a legally binding agreement will exist between us under these terms and conditions. We will take payment for your order immediately and goods will not be despatched until receipt of payment. Whilst we are under no obligation to accept your order, we would normally do so where (i) the product is available, (ii) the order reflects current pricing and (iii) your credit card/debit card payment is approved by your credit card/debit card company.
We reserve the right to cancel your order and the contract between us if: (i) we have insufficient stock to deliver the goods you have ordered; (ii) we do not deliver to your area or (iii) one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel your order and the contract between us we will notify you by email and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment or other losses suffered by you of any nature.
Liability
If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 working days of the delivery of the goods in question.
If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.
If you notify a problem to us under this condition, our only obligation will be, at your option: (i) to make good any shortage or non-delivery; (ii) to replace or repair any goods that are damaged or defective; or (iii) to refund to you the amount paid by you for the goods in question in whatever way we choose.
Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question as referred to above.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Delivery
When can I expect my orders to arrive?
All orders received through SHO Fine Jewellery are processed and, if the stock is available, dispatched within 3 to 5 working days of receiving the order. Therefore, depending on the availability of stock, your products will usually be with you in just a few days. Any product that is out of stock is displayed as such on the website and you will not be able to order that product until it is back in stock.
Why would my contact address be different to my delivery address?
In some instances the items you order will be delivered by courier. If no one will be able to sign for the goods at your contact address you may wish to send the goods to an address where someone will be able to accept the goods during normal business hours (i.e. a work address).
If the items you order are intended for a gift you may wish to have the goods delivered directly to the gift recipient, but have the receipt sent to your own address.
Can I track my order once it has been dispatched?
You may only track an order that has been dispatched using Royal Mail Special Delivery and if a consignment number has been provided. To track the order after despatch simply sign-in to your account information page and then click on "track a recent order". If a consignment number appears against an item(s) in your order, simply click on the number and you will be directed to the Royal Mail web-site where you can see the delivery status of your order.
